DMCA / Copyright Policy
Nastia respects the intellectual property rights of others and responds to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
How Nastia Works
Nastia is a closed, private service. Each user creates a private AI companion for their own personal use, and imagery and video are generated by AI. There is no public feed, no public profiles, and no sharing of content between users. Users may upload their own reference images, which are stored privately in their account. If you believe content on the Service infringes a copyright you own or control, you may submit a notice as described below and we will act on it.
Reporting Copyright Infringement
To report material you believe infringes your copyright, send a written DMCA notice to our designated agent at legal@nastia.ai. To be effective under the DMCA, your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed (or a representative list, if multiple works are covered by a single notice).
- Identification of the material you claim is infringing, with information reasonably sufficient to permit us to locate it (for example, the account email, a username, a description of the companion, or screenshots).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
Please note that under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly materially misrepresent that material is infringing.
How We Respond
- We acknowledge complete DMCA notices promptly after receipt.
- Upon receiving a valid notice, we expeditiously remove or disable access to the material identified as infringing.
- Where appropriate, we notify the affected account holder and provide them a copy of the notice so that they may submit a counter-notification.
Counter-Notification
If you believe material was removed or disabled by mistake or misidentification, you may send a written counter-notification to legal@nastia.ai. To be effective, it must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and the location at which it appeared before it was removed.
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
If we receive a valid counter-notification, we may restore the removed material in 10 to 14 business days, unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
Repeat Infringers
In accordance with the DMCA and our Terms of Service, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
